Definitions
‘Planet’ websites mean the following sites: www.planet-habitat.com, www.locations-en-montaigne.com and www.planet-swap.com.
‘Party’ or ‘parties’ mean all Planet sites and/or members, and/or visitors.
‘Member’ means the individual who has created an account on Planet websites and has authority of access and use in order to create, extend, modify or cancel his or her advertisements concerning rentals, sales or exchange of property.
‘Visitor’ means an unidentified person who has the right to consult advertisements concerning rentals or sales of property.
‘Service’ means the database on the public or private areas of Planet websites, containing the administration of the account and all the advertisements available to members according to the following terms and conditions.
‘Terms and Conditions’ mean the current terms and conditions concerning access and use.
Accessing the Members’ Service
Members must first fill in a registration form in which they supply correct, full and up-to-date information. They must also accept the Terms and Conditions. Information supplied should be revised regularly in order to take account of any changes.
In the event of Members supplying false, incorrect or incomplete information, Planet sites reserve the right to refuse access to the Service or to suspend or cancel this access.
Members permit access to the Members’ space on Planet sites and are strictly personal. Consequently, members undertake to keep such information confidential and to take responsibility for any outcomes, especially financial, in the event of this information being used by a third party.
In general terms, Planet websites reserve the sole discretionary right to cancel or restrict all access rights given to Members at any time and without notice. When this occurs, Planet websites will inform Members of the cancellation or restriction of access.
Service use
Members undertake to use the Service solely within the limits of access granted, as defined below:
Members’ access: updating of the account and advertisements, contacting individuals publishing advertisements for rentals, sales or exchange of property.
Visitors’ access: consulting and contacting individuals publishing advertisements for rentals, sales or exchange of property.
Members have the responsibility to ensure that identity details and descriptions are correct. They are also responsible for ensuring that interior or exterior views shown on photos relate only to the advertised property and that they accurately portray the property.
Under no circumstances will ‘Planet’ websites be held responsible for the content, lack of information or publication of the advertisements on the site. Members are solely responsible for the compilation and publication of advertisements.
Any liabilities arising from the publication of an advertisement fall solely to the Member who relieves Planet websites of all commitments and liabilities in relation to third parties.
Visitors undertake to consult and contact Members concerning rental offers or sale of property.
Planet websites have an intermediary role In all transactions. They cannot be held responsible for the misuse of the site and, in a general manner, for any misappropriation of funds on the part of the property owner or Visitor.
Members undertake to copy, duplicate or reproduce, in whole or in part, advertisements solely for their personal needs.
All other use (commercial use, research and development) is dependent on prior written approval from Planet websites.
The contents of the Service must not be used in any way which could prove detrimental.
Members or Visitors are entitled to print and download results from searches with limited access (exchange of property), wholly or in part, on the condition that the search resultswholly or in part, are not distributed or transmitted in any other manner. They are not entitled either to duplicate the entire Service or to create subsets or databases using information from the Service.
Advertisement Content
Advertisements must be clear and understandable
Members must give as much information as possible on situation, equipment, description, photos, prices (in the case of letting and sale of property), dates (in the case of letting and exchange of property).
Members should not include email and telephone details as there is a specific space for these on the form.
In the case of exchange of property, the general description and family description fields must be filled in before the advertisement is published on Planet websites.
All advertisements that are incomplete or have major mistakes may be refused or suitably modified without the agreement of the Member and without Planet websites being called upon to justify the changes which may take place during publication.
All advertisements of a defamatory or abusive nature or containing pornographic images will be refused immediately without any justification.
Service availability
Planet websites undertake to make every effort to ensure that the Service is accessible 7 days a week, 24 hours a day. However, no undertaking is given that the Service will function without interruption or breakdown. Attention is drawn to the fact the service may be interrupted for a period of time for maintenance, updating, technical improvements or content and/or presentation development.
Therefore, Planet websites reserve the right to suspend, at any time, temporarily or permanently, access to the Service, in whole or in part.
Intellectual property
When printing, downloading, copying and/or reproducing parts of the website, Members undertake not to withdraw, conceal or change information relating to property rights (including information relating to author’s rights and brands) which may be appended to or contained in the Service.
Personal data
Planet websites are non-commercial and therefore are granted dispensation No. 7 regarding declaration of information to CNIL* (Commission Nationales de l’Informatique et des Libertés).
Under the law concerning data and individual liberties dated 06-01-1978, you have the right to access, change, correct or delete data which concerns you. If you wish to exercise this right, please contact us.

Guarantees - Responsibilities
www.planet-habitat.com and www.locations-en-montagne.com are internet sites for the dissemination of advertisements and posting of property rentals and sales.
. Www.planet-swap.com is an internet site for the dissemination of advertisements and offers for the exchange of property.
Consequently, Planet websites do not take any responsibility as to whether property transactions are entered into or completed.
Members or Visitors have access to and the use of the service at their own risk, their own costs and incur their own liability.
Under no conditions will Planet’ websites incur any liability: Members or Visitors relinquish any recourse to action for all damages, irrespective of the character of the latter (physical, material, financial…).
In the event of this exclusion of liability being judged illegal in the light of new legislative and/or statutory arrangements, the parties agree that Planet websites will not be responsible in any event for damages which members could incur indirectly, such as, and the following is not a definitive list, financial loss, data or programme loss, rental, sales, property exchange loss.
Termination
In the event of members not adhering to the conditions noted here, Planet websites reserve the right to end the access it has granted, without prior final warning.
DSimilarly, members can request the termination of their account on Plane’ site at any time and without notice.
In both cases described above, no financial compensation will be given.
Amendments to conditions
Planet’ sites can modify and publish the conditions contained in this document at any time and without notice. Members undertake to accept these amendments and their publication. Members should regularly check the current conditions published by the Service.
Law in force- resolution of disputes
The present conditions are governed by French law.
In the event of parties not agreeing to an amicable resolution, any dispute between the parties relating to the existence, validity, interpretation and/or enforcement of the conditions will be referred to the competent tribunal in Albertville (Savoie), notwithstanding the plurality of respondents or third parties being called upon to join the action.
